WePlai operates is a U.S.–only platform for AI video creation and community features, including skill-based contests. This Privacy Policy explains how we collect, use, disclose, and protect personal information when you use our website, mobile app, and related services (the “Services”).
Age/GEO: The WePlai app is available to U.S. users aged 13 and older. Contests, coin purchases, and payouts are available only to users aged 18 and older (age verification required before payouts). If you are under 13, do not use the Services.
1) Scope & Eligibility
This Policy applies to personal information we process about individuals located in the United States who use the Services. WePlai does not target users outside the U.S. If you access from elsewhere, you do so on your own initiative and your information will be processed in the U.S.
2) Information We Collect
A. Information You Provide
- Account & Profile: name/username, email, date of birth (DOB), profile image/avatar.
- Authentication: email and/or phone (if used) for one-time passwords (OTP) and account verification.
- User Content: videos, captions, prompts/workflow notes, flags/reports you submit.
- Contest Activity (18+ only): categories/lobbies joined, entries submitted, ratings you receive; AMOE requests; support requests.
- Payments & Payouts (18+ only): On iOS, purchases run through Apple In-App Purchase (we don’t receive your card details). On web, purchases run through Stripe (we don’t store full card data). Winners complete payout/KYC via Stripe Connect (e.g., legal name, address, tax information such as W-9 data) as required by law.
- Communications: messages to support, survey responses, and other correspondence.
B. Information Collected Automatically
- Device & Usage: device identifiers, OS/version, app version, IP address, timestamps, referrers, crash logs, performance data.
- Log & Event Data (fairness & security): ratings events (including hashed rater ID, device hash, IP hash, view order, raw & normalized scores), entry events (18+), payout events (18+).
- Location (coarse): statenlevel location inferred from IP and—if you allow—device location, to enforce age/state restrictions (18+ contests; restricted states).
- Cookies/SDKs (web/app): session management, security, analytics, and essential features.
C. From Service Providers/Partners
- Payments/Payouts/KYC (18+): status/identifiers from Apple (IAP) and Stripe (KYC, tax forms, payout readiness).
- Email/SMS Delivery: bounce/complaint data from providers (e.g., Amazon SES) to protect deliverability.
- Fraud/Security/Hosting: hosting, analytics, and anti-abuse vendors provide risk and performance signals.
3) Payments, Payouts & Tax Information
What we collect/receive. To enable payouts and tax reporting, we work with Stripe. Depending on your activity, Stripe may collect and process your identifiers (name, email, phone, date of birth, address), government identifiers (e.g., SSN/TIN for U.S. tax), and financial information (bank/debit details). We receive limited status indicators from Stripe (e.g., payout enabled/disabled, tax form status, payout status, 1099 delivery status) and ledger amounts needed to operate your account.
Who receives it. We share necessary information with Stripe to provide payouts and comply with law. For certain data, Stripe acts as an independent controller (e.g., KYC/AML, tax information). See Stripe’s privacy policy for details.
What WePlai stores. WePlai does not store your full bank account numbers or SSN/TIN on our servers. Those are collected and stored by Stripe. We may store limited payout/tax metadata (e.g., “Stripe account connected,” “W-9 complete”) and your USD Winnings ledger.
Why we use it (legal bases). To perform our contract with you (payout prizes), comply with legal obligations (identity checks, tax reporting), and prevent fraud.
Retention. We retain payout/tax records as required for legal compliance and record-keeping. Stripe maintains its own retention per law.
Your choices. You may update or correct payout/tax details in the Stripe dashboard provided during payout onboarding. Declining to provide required payout or tax information may delay or prevent payouts.
3) How We Use Information
We use personal information to: (1) provide & operate the Services (accounts, authentication, content display, ratings feed); (2) ensure fairness & integrity for contests (18+ only) including equalized ratings, anonymous judging, score normalization, brigading/bot detection, and audits; (3) process payments & payouts for eligible adults (coin purchases via Apple/Stripe; winner onboarding to Stripe; KYC/AML; tax reporting such as 1099); (4) security & legal compliance (age/state restrictions, DMCA/IP enforcement, fraud prevention, platform policy compliance); (5) communicate (transactional emails/SMS for verification, OTP, receipts, winner notices, product/policy updates); (6) improve & support (diagnostics, bug fixes, analytics to improve product quality and safety); (7) legal purposes (maintain records, comply with obligations, defend legal rights). We do not use personal information for targeted advertising or cross-context behavioral advertising.
4) Minor Users (Ages 13–17)
Access: Users aged 13–17 may access non-monetary features such as the rating feed and allowed community features. Restrictions: Users aged 13–17 cannot enter contests, purchase Coins, or receive payouts. Data minimization: We collect only what is necessary to provide permitted features (e.g., account, ratings activity, device/IP for security). Defaults: We avoid targeted advertising and limit data sharing to service providers. Users 13–17 (or their parent/guardian) may exercise privacy rights described in Section 10.
5) Legal Bases (transparency)
We process data under: contract (to provide Services), legitimate interests (security, fraud prevention, fairness), consent (e.g., device location, push notifications), and legal obligations (tax,KYC, DMCA).
6) How We Share Information
Service Providers/Processors: Stripe (Connect Express) for payouts/KYC/tax (18+), Apple for in app purchases (18+), AWS/SES and similar for hosting and email, and fraud/security/analytics vendors for abuse detection and performance. Legal/Compliance: rights holders (DMCA), regulators, law enforcement, or others when required by law or to protect users, our rights, or the Services. Corporate Transactions: as part of a merger, financing, or sale of assets, subject to confidentiality. We do not sell personal information and we do not “share” it for cross context behavioral advertising.
7) Your Choices & Controls
Account & Profile: update info in the app or contact support to correct inaccuracies. Email/SMS: disable nonessential communications; transactional security messages are required. Location: you may deny device location; we’ll rely on IP-based state detection to enforce eligibility. Cookies (web): manage via browser settings; essential cookies are required. Push Notifications: manage via device settings.
8) Data Retention
Account/profile: for the account life and a reasonable period after closure (backup, fraud, legal). Ratings/audit logs: typically up to 24 months for fairness audits and appeals. KYC/tax & payout records (18+ winners): retained per law (often up to 7 years). DMCA/takedown records: retained as required. We may identify data for analytics and product improvement.
9) Security
We use administrative, technical, and physical safeguards appropriate to the data (e.g., encryption in transit, access controls, audit logging). No system is 100% secure. You are responsible for protecting your account and OTP codes.
10) State Specific Privacy Rights (U.S.)
Depending on your state (e.g., California, Virginia, Colorado, Connecticut, Utah), you may have rights to access, correct, delete, or obtain a copy of certain personal information, and to appeal a decision. Submit requests to support@weplai.app with the subject “Privacy Request.” We will verify identity (and residency) before responding. Authorized agents (CA) may act on your behalf; we may require proof of authorization and identity verification. We do not sell personal information and do not share it for cross context behavioral advertising. We do not respond to Do Not Track signals; tracking is limited to essential security/analytics. Minor content removal (CA): If you are a registered user under 18 and reside in California, you may request removal of content you posted, subject to exceptions under California law.
11) Children’s Privacy
WePlai is available only to users aged 13 and older. We do not knowingly collect personal information from anyone under 13. If you believe a child under 13 has provided information, contact privacy@weplai.app and we will delete it. Users aged 13–17 receive additional protections and restrictions as described in Section 4.
12) International Users
WePlai is U.S.–only. If you use the Services from outside the U.S., you understand your information will be processed in the United States, where laws may differ.
13) Third Party Services & Links
The Services may link to third party sites or services. Their privacy practices are governed by their own policies. We are not responsible for third party privacy practices.
14) Public Content & Ratings
Content you submit (e.g., entries if 18+, profile name, avatar) may be visible to others. Do not include personal information you intend to keep private. Ratings are anonymous to other users; WePlai maintains rating logs internally for fairness and security.
15) Automated Decision Making (Fairness Note)
Contest outcomes may incorporate algorithmic scoring and normalization to ensure skill-based, fair results. They do not produce legal effects about you beyond contest outcomes. You may contact support to appeal a result; appeals include human review.
16) Changes to This Policy
We may update this Policy from time to time. We’ll post the updated version with a new Effective Date and, if changes are material, provide additional notice (e.g., in app banner or email). Continued use of the Services after the Effective Date indicates acceptance.
